Inability to get through to the IRS line

Is everyone as frustrated as I am? How are we supposed to address our submission errors if we can not get through to the IRS?

I have been trying feverishly to get through, calling every 10 minutes for the last three days. 95% of the time, I get the message that basically says we're too busy to even bother answering your call. On the two instances where I did get through and was placed on hold, I get randomly dropped after holding for 2:10 on one ocassion and had to drop off myself last night after holding for 1:27.

I'm getting a bit nervous about getting fined for not having our files in on time. Does anyone know if we still face fines, even if our initial submission attempts can be proven to have occurred prior to the June 30th deadline? Or, must all of our submissions actually be processed and accepted by that date?

We have been unable to get through as well. Not sure this is a good plan of action but we are going to send an email to airmailbox@irs.gov with our questions in regard to the file rejections for our entities; document our times spent on the phone on hold so they know we have made several attempts; and file for an extension (Payroll Manager is researching how this can be done).

when I got through the other day, I was told that we have 60 days from the file submission to correct the errors. My issue is understanding the errors.

We would like to think that as long as we have documentation proving our initial submission attempt was prior to the due date, we should be safe, but have not found any thing in writing showing that to be the case. At this point, it is simply what we believe to be a logical assumption on our part, but we're hoping that some body within the community might be able to confirm (or deny) this for us. Thanks.

The June Webinar pointed everyone to IRS Publication 1586 - www.irs.gov/.../p1586.pdf - "Reasonable Cause Regulations and Requirements for Missing and Incorrect Name/TINs" which hasn't been updated for the purposes of the ACA but details what's expected of companies for other filings where TIN errors could occur.

I waited on hold for about 2 1/2 hours yesterday. I had a very nice gentleman and he did say as long as you are making a good faith effort to correct your errors you will not be penalized for not getting the corrected files by the 30th.

Might I suggest that all the communications with the IRS be archived (and possible support forum links) so that in the event that the IRS wants to get to engage in litigation, you have enough supporting documentation to show that you (in good faith) were trying to comply with the requirements, but that their lack of documentation, proper procedures, and poor systems prevented you from complying. That would include support cases with Infor/Lawson.

That does not mean that you should not earnestly attempt to resolve the issue before the deadline, but that you may have legal permission to not be in compliance.

I find it hard to believe that if this is an issue with the Infor/Lawson software that multiple clients would not be hounding Lawson for a resolution. Like wise for Infor/Lawson, if it is an industry problem, should they also be aware of other vendors that are in the same situation?

We are working with an independent consulting group to send our file. They have directed us that we need submit the file by June 30th. If it is rejected due to errors, we have sixty days to correct the errors and resubmit. The errors do not need to be corrected and the file resubmitted by June 30th.

We talked with IRS yesterday about the same issue. Even if you get errors as the file being rejected in PROD, the IRS person told us you have 60 days after that to correct them. We just got our test file through yesterday. It will take 48 hours for the IRS to turn on the production flag before we can send our production file.
