Attorney fees for 1099's

Hi - I would like some feedback as to how your companies view the attorney fee regulation with the IRS. We have issues getting the attorneys to provide a W-9 and was wondering if any one else has this issue. We have garnishments for payroll that are sent to attorneys and we are wondering how other clients deal with this type of situation.

We have had this issue in the past too. We have required all vendors that are added to our system to have a W-9 on file regardless of whether they would get a 1099 or not. We tell our vendors that they will not be paid until one is on file because we are required by the IRS to have one on file. If the attorney is receiving the payment as a third party, we do not issue them a 1099. We only send 1099's to attorneys that are directly providing our organization their services.
