frx files vanishing on opera3

Has anyone had this since upgrading a site to opera 3.
Have a large site where recently the frx files are disappearing resulting in an "another user has exclusive access " error appearing. happens on various reports and has occured 6 times in 3 weeks
We suspect the sophos anti virus (v10) but need to confirm this without leaving the site exposed.
